Exhumation in Portugal is regulated by a single state decree, and the rules there are quite clear. The main point: an in-ground grave cannot be opened earlier than three years after burial. Below we explain how to transport a loved one from Portugal and rebury them at home in Ukraine. We arrange every detail of exhumation from Portugal and bring the remains home to Ukraine. Families whose relative has not been buried yet can turn to repatriation from Portugal.
In 30 seconds.
“You were always available, whatever the time…” — Віта Х. “Everything was organised with great dignity, professionally and with attention to every detail.” — Тамара Ю. “Every question was resolved promptly, with respect and attention to detail.” — Olha B. “…your support, compassion, sense of responsibility and professionalism meant a great deal to us.” — Ірина Б. “It all went quickly and professionally…” — Оля К. The Portuguese decree directly lists who has the right to submit an application, in the following order of priority (Article 3):
If the deceased was not a citizen of Portugal, the application can also be submitted by a diplomatic or consular representative of their country. For a Ukrainian, this is the Embassy or Consulate of Ukraine.
The application can also be submitted by a person holding a power of attorney with special powers from someone who holds the right. Therefore, the family in Ukraine usually does not need to travel to Portugal: you sign a power of attorney, and we submit the application.
Main document: Decree-Law 411/98 on the transport, burial, exhumation, transfer, and cremation of bodies (Decreto-Lei n.º 411/98).
The application is submitted at the cemetery or at the municipality's cemetery service. For example, the manual of the Municipality of Cascais states: when submitting the application, you must immediately choose what will happen to the bones. For us, this means: the burial place in Ukraine must be known in advance.
The decree does not set a processing period. Usually, the cemetery sets the exhumation date and notifies the family. We clarify the exact timelines with the local authority.
Article 21 of the decree: after burial, it is forbidden to open an in-ground grave earlier than three years. An exception is made only by a decision of a court or the prosecutor's office.
If during the opening the body has not yet decomposed, it is covered with soil again and left for another two years. This is repeated until only bones remain.
This is important for the family. From an in-ground grave, as a rule, bones (ossadas) are brought to Ukraine, rather than a body. The situation is different with a vault (jazigo): there a person is buried in a zinc coffin, and the restrictions of Article 21 apply specifically to an in-ground grave. We check how it will work in your case at the cemetery.
The decree does not establish any prohibited months. We did not find separate rules for infectious diseases during exhumation in the decree. Supervision over compliance with the rules is carried out by the cemetery administration, the police, and the health authority (autoridade de saúde).
Urn. Ashes after cremation in Portugal can be transported freely in a suitable urn (Article 6). If the urn is placed in a columbarium or buried, we clarify the release procedure with the cemetery administration.
The exhumation is carried out by cemetery workers. According to the Cascais manual, the grave is opened and they check whether the body has completely decomposed. If so, the bones are removed, washed, disinfected, and dried, and then placed in a box with a nameplate so as not to mix them up.
For transport, the decree requires:
We use a hermetically sealed coffin with a zinc liner, or a metal box, for transport.
Another option: to cremate the bones or body after exhumation. The decree allows this (Article 15), and then an urn is brought to Ukraine.
We clarify the list of documents for entry into Ukraine with the Embassy of Ukraine in Portugal. More on the documents page.
In Ukraine, a new burial requires a plot at the cemetery and a decision by the local government body. We explained how this is arranged in the article exhumation and reburial in Ukraine. We help with the plot and the funeral in your city.
There is no single tariff. The fee for exhumation and transfer is set by each municipality or parish in its cemetery regulations and fee schedule. The state fee that we know for sure: apostille €10.20.
What is included in the costs:
Our exhumation service costs from €500 plus the cost of transport (repatriation) from Portugal. We calculate the exact amount for your situation, including local fees. For transport, we work without prepayment: payment is made after handover under the contract.
